The agreement between Fluno and the hotels that subscribe to it. Please read these terms carefully before using the service.

By creating an account or using Fluno, you ("the Customer", "you") agree to these Terms of Service with Fluno ("Fluno", "we"). If you are accepting on behalf of a hotel or company, you confirm you have authority to bind it. If you do not agree, do not use the service.
You must be a business and at least 18 to use Fluno. You are responsible for keeping your credentials confidential and for all activity under your account. Notify us promptly at support@tryfluno.com of any unauthorized use.
Fluno provides AI-powered guest messaging across WhatsApp, Instagram, Facebook, web chat, and voice, with integrations to your existing systems. Available features depend on your plan (see pricing). We may improve, add, or modify features over time; we will not materially reduce core functionality of a paid plan without notice.
Fees are shown at sign-up and on our pricing page and are billed in advance for the chosen period. Unless stated otherwise, fees are exclusive of applicable taxes (including GST). Fees are non-refundable except where required by law or expressly stated. We may revise pricing with at least 30 days' notice, effective from your next billing period.
We may offer a free trial or pilot with usage limits. Trials are provided "as is" and may be changed or ended at any time. At the end of a trial, paid fees apply unless you cancel.

We may suspend accounts that breach this section to protect the Service and other customers.
For Guest Data, you are the data fiduciary and Fluno is your processor. You are responsible for collecting Guests' consent under the DPDP Act and any other applicable law, and for the lawfulness of the instructions you give us. We process Guest Data only to provide the Service and per our Privacy Policy.
We store data in India (AWS Mumbai), encrypt it in transit and at rest, restrict and log access, and never use your data to train AI models. Full details are in our Privacy Policy, which forms part of these Terms.
Fluno and its software, branding, and content are owned by us. You retain all rights to your own data and content. You grant us a limited licence to process your data solely to operate the Service. We may use aggregated, de-identified data to improve the Service.
Each party will protect the other's confidential information and use it only to perform under these Terms. This does not apply to information that is public, independently developed, or required to be disclosed by law.
We target high availability and provide support by email and in-dashboard. Enterprise plans may include a written service-level agreement with uptime commitments and credits. We may perform maintenance, ideally with advance notice.
The Service is provided "as is" and "as available". AI-generated responses may be imperfect; you are responsible for reviewing and supervising automated guest communications. To the extent permitted by law, we disclaim implied warranties of merchantability and fitness for a particular purpose.
To the maximum extent permitted by law, Fluno's total liability in any 12-month period is capped at the fees you paid us during that period. We are not liable for indirect, incidental, consequential, or lost-profit damages.
You will indemnify Fluno against claims arising from your breach of these Terms, your misuse of the Service, or your failure to obtain required Guest consents.
These Terms apply while you use the Service. You can cancel at any time from the dashboard; cancellation takes effect at the end of the current billing period, with no lock-in on standard plans. We may suspend or terminate for material breach or non-payment. On termination, we delete your data per our Privacy Policy retention schedule.
These Terms are governed by the laws of India. Subject to applicable law, the courts at Gandhidham / the jurisdiction of our registered office will have exclusive jurisdiction, and the parties will first attempt good-faith resolution.
We may update these Terms as the Service or law evolves. Material changes will be notified by email or in-dashboard before they take effect; continued use after that constitutes acceptance.
